Wrongful Dismissal and Employment Severance Claims

Can I Receive Severance Payments?
What if I Have Been Laid Off?

Employment Severance is payable to any employee laid off or fired, without cause, and where no employment contract restricts severance. Scenarios where this can occur include:
- Corporate Restructuring or Layoffs: Being laid off or fired due to corporate downsizing or restructuring does not excuse employers from paying severance.
- Business or Store Closing: your company closing down does not mean you are not entitled to severance.
- Reducing your Salary or Responsibility: If an employer reduces your salary without your permission, or significantly changes your job description or responsibilities, this could constitute “constructive dismissal.”
- Dismissal Due to Maternity or Parental Leave: If an employer replaces you while on leave, you are entitled to severance and compensation for breaching the Employment Standards Act.

What is Wrongful Dismissal?
Wrongful termination occurs when an employee is fired or laid off in violation of the BC Employment Standards Act or contractual agreements. This can include terminations based on:
- Discrimination: Firing an employee based on race, gender, age, disability, religion, or other protected characteristics. We can help you pursue your rights both in Court and the BC Human Rights Tribunal.
- Retaliation: Termination in response to an employee's lawful actions, such as reporting illegal activities or participating in whistleblower activities.
- Breach of Contract: Terminating an employee in violation of the terms specified in an employment contract or collective bargaining agreement.
- Violation of Public Policy: Termination that contradicts established public policy, such as firing an employee for serving on jury duty or taking legally protected family leave.
